1. Agreement and scope
These Terms of Service (“Terms”) govern access to and use of the MaxVFY Shopify application, MaxVFY verification-request pages, and related services (collectively, the “Service”). By installing, accessing, or using the Service, you agree to these Terms. If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. What MaxVFY does
MaxVFY allows a Shopify merchant to create a secure, time-limited identity-verification request, share the request by link or QR code, observe request progress, and receive a verification outcome. MaxVFY also provides merchant-entered references and notes, search, archive/unarchive, history, and related audit functionality.
Identity verification is performed through a hosted third-party verification technology service. MaxVFY is not an identity-document repository for the merchant dashboard and is not designed to expose identity documents, selfies, liveness videos, biometric templates, or document numbers to merchants.
3. No guarantee of identity, trustworthiness, or transaction safety
Merchants remain responsible for their own transaction decisions, policies, legal obligations, notices, recordkeeping, customer communications, and any independent investigation or review required by law.
4. Merchant responsibilities
A merchant using MaxVFY agrees to:
- request verification only for a legitimate, lawful business purpose;
- provide any notices, lawful basis, consent, or authorization required for the merchant's purpose and jurisdiction;
- not use MaxVFY to unlawfully discriminate, harass, stalk, intimidate, or obtain information for an improper purpose;
- not use the Service as the sole basis for a decision where law requires additional procedures or human review;
- not enter unnecessary sensitive personal data in the merchant reference or internal-note fields;
- not attempt to access identity documents or biometric materials outside the permitted verification workflow;
- keep the merchant's Shopify account and administrative access secure; and
- comply with Shopify's applicable terms, policies, and platform requirements.
5. Recipient responsibilities
A verification recipient must be at least 18 years old and may use a request only for the purpose for which it was issued. A recipient must submit truthful information, use their own documents unless legally authorized otherwise, follow verification instructions, and must not upload forged, altered, stolen, or misleading documents or attempt to defeat security, liveness, anti-spoofing, or fraud controls.
6. Secure links and request lifecycle
Verification links are time-limited and intended for the designated verification interaction. A request may be pending, opened, continued, started, successful, unsuccessful, expired, cancelled, or otherwise subject to review. A merchant may cancel an eligible request. A fresh link may be available without charge only where the prior request expired or was cancelled before a provider verification session began.
7. Fees and Shopify billing
MaxVFY's production pricing is disclosed in the Shopify App Store and in the app. The intended usage model is no monthly subscription fee and a $2.99 USD usage charge for each successfully completed verification. Creating, opening, expiring, cancelling, or receiving an unsuccessful result is not intended to create that successful-verification usage charge.
Where Shopify-managed billing is enabled, charges are submitted through Shopify and are also subject to Shopify's billing terms and merchant billing cycle. See the Billing & Refund Policy for details.
8. Third-party services
The Service relies on Shopify for app distribution, authentication, platform functions, and billing, and relies on an identity-verification technology provider for the hosted verification checks. Third-party services are subject to their own availability, technical requirements, and legal terms. MaxVFY is not responsible for independent acts, outages, changes, or omissions of services outside MaxVFY's control.

9. Availability, security, and changes
We may maintain, modify, suspend, limit, or discontinue all or part of the Service when reasonably necessary for maintenance, security, abuse prevention, legal compliance, provider changes, platform changes, or business operations. We may impose reasonable technical or anti-abuse controls. Such controls are not merchant product quotas and may be adjusted to protect service integrity.
10. Prohibited use
You may not use the Service to violate law or another person's rights; impersonate another person; facilitate identity theft; collect verification information for resale; circumvent security controls; probe or attack the Service; introduce malicious code; automate abusive request volume; interfere with another merchant or recipient; or reverse engineer the Service except where such restriction is prohibited by law.
11. Intellectual property
MaxVFY and its associated software, interface, branding, documentation, and original content are protected by applicable intellectual-property laws. These Terms grant only the limited right to use the Service as provided. No ownership rights are transferred.
12. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation, acceptance of every identity document, completion of every verification, detection of every fraudulent act, or any particular business result. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
13. Limitation of liability
To the fullest extent permitted by law, MaxVFY will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, business opportunity, or data, arising from use of or inability to use the Service. To the fullest extent permitted by law, MaxVFY's aggregate liability for claims arising from the Service will not exceed the greater of (a) the fees paid to MaxVFY for the affected Service during the three months before the event giving rise to the claim or (b) USD $100. These limitations do not apply where prohibited by law.
14. Indemnity
To the extent permitted by law, a merchant agrees to defend, indemnify, and hold MaxVFY harmless from third-party claims arising from the merchant's unlawful use of the Service, unlawful verification purpose, violation of these Terms, violation of another person's rights, or merchant content entered into the Service. This section does not require indemnification for MaxVFY's own fraud, willful misconduct, or liability that cannot lawfully be shifted.
15. Privacy
Use of the Service is subject to the MaxVFY Privacy Policy and, for verification recipients, the Verification Privacy Notice.
16. Termination
A merchant may stop using the Service by uninstalling the app, subject to billing and retention obligations already incurred. We may suspend or terminate access for material violation of these Terms, security risk, abuse, legal requirements, Shopify platform requirements, or nonpayment where applicable.
17. Governing law
Except where mandatory law requires otherwise, these Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law principles. Any dispute that is not subject to a mandatory forum will be brought in a court of competent jurisdiction in Utah.
18. Changes
We may update these Terms as the Service, law, Shopify requirements, or verification-provider requirements change. The current version will be posted here with its effective date. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.
